For Girls Like You Club – Membership Terms & Conditions

For Girls Like You Club creates an opportunity for girls to draw closer to Christ through community and discipleship. This document details from the outset the way in which we will deliver our services to you. If you are planning to join the For Girls Like You Club, (“the Membership”) then you must read these terms and conditions in full prior to purchasing.

1. Membership Terms & Conditions (‘Terms’): Key Details

These Terms cannot be varied and in proceeding to purchase the Membership you will be deemed to have accepted these Terms. The Terms set out below apply to the services offered by For Girls Like You Ministries. Please read them carefully as they affect your rights and liabilities under law and set out the Terms under which For Girls Like You Ministries (“we”, “our” or “us”) provide services to you, as purchaser of the Membership. These Terms are subject to any rights you have under consumer law to which we are bound and which cannot be waived by contract. 

Please be aware that we may update these Terms at any time. Your continued use of the Membership indicates your acceptance of the terms and agreement to any changes. 

2. Membership Outline

The Club is a membership platform for entertainment and education related to the spiritual life of girls. The Membership is an ongoing commitment where you can get regular support and guidance. 

3. Membership Specifics

These are the main elements to the Membership:

1. Weekly devotional delivered to your mailbox and App
2. Access to our live club calls every other month on zoom
3. For Girls Like You Magazine subscription
4. Weekly video thoughts from Alena in the For Girls Like You app
5. Fun extras in the mail

Live Club Calls

These live streams will be held on Zoom. They are typically held every other month.

Weekly devotional

These will be mailed to the address we have on file as well as accessible in our app.

For Girls Like You Magazine subscription

This will be delivered every other month to your mailing address on file.

Weekly video thoughts from Alena

These video recordings are available in the App and club member web portal.

4. Behavior

It is requested that at all times your behavior towards others is polite and respectful. Should your behavior be deemed offensive or inappropriate we reserve the right to remove you from the Membership with immediate effect. 

Each person is responsible for their own behavior and we will not be held responsible for the behavior or actions of any other Members.

5. Membership Fees and Payment Terms

The cost of the Membership is set at the time you subscribe. Upon joining you will agree to regular payments via Stripe (our payment processor) which will be taken out monthly, quarterly, or annually depending on your membership tier.

We reserve the right to change the content and delivery method of said content within the membership and the associated price point at any time. Should we change the membership cost we will provide you with at least 30 days’ notice.

6. Refunds and Cancellation 

It is our aim that you will be completely happy with your Club Membership. However, we appreciate that there may come a time when you wish to leave the Membership. 

As you have instant access to our entire catalogue of Devotionals and Videos you will not be entitled to a refund of your subscription fees should you join and then wish to leave. Please consider the details of the Membership carefully before purchasing and get in touch to ask any questions about suitability. You will not be entitled to a refund if you change your mind. Your statutory refund rights are not affected. 

Should you wish to cancel your Membership you may do so on the Membership tab of My Account. You will continue to have access until the expiration of your current paid membership period and will not receive credit for any unused portion of that period.

We reserve all rights to cancel the program for any reason without prior notice. In such circumstances a refund will be provided for the remainder of your term as applicable. 

Notwithstanding any right or remedy available to us, we may cancel your Membership with immediate effect:

• If you fail to pay your Membership fees by the relevant due date;
• If you commit a repudiatory breach of the Terms of this agreement; 
• As decided at our sole discretion from time to time

7. Limitation of Liability and Indemnification

To the fullest extent permitted by applicable laws, we limit liability and responsibility for any harm resulting from your use of all or any part of the Membership. We shall not be liable to you for any damages, including lost profits, whether such claim is based on warranty, contract, tort or otherwise.

If we are found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Membership, our liability shall in no event exceed the total of any fees with respect to the Membership received by us from you, during the 6 months preceding the date on which the claim arose.

Nothing in these Terms shall limit or exclude our liability in respect to fraudulent misrepresentation, death, or personal injury, resulting from our negligence, or any other liability which cannot be limited or excluded by law. 

You agree to indemnify, defend and hold us, our subcontractors and employees, harmless from any claim or demand, including solicitors’ fees, made by a third party due to or arising out of your breach of these terms, or your violation of any law or the rights of a third party.

8. Privacy and Confidentiality

Your privacy and protection of your personal data is important to us. You are responsible for ensuring that your contact details are accurate and up-to-date, at the time of registration, and on an on-going basis thereafter. 

Your personal data is protected as set out in our privacy policy which can be found https://forgirlslikeyou.com/privacy-policy/. By providing your personal data you agree to the terms of our privacy policy. 

During the course of the Membership you may have access to confidential information, in particular the personal affairs of other members. In accepting these Terms, you agree that you will not use or disclose to any person, organization or company, and shall use your best endeavors to prevent the publication of, any confidential information relating to any other member.  

You accept that any unauthorized disclosure of personal or confidential information belonging to another may amount to immediate dismissal from the Membership. Should you decide to leave the Membership then you remain bound by the confidentiality and privacy obligations.

Please be aware that we record our events and save the chat transcript so your your name, chat comments and image/video may be captured. We do not typically record members and will explicitly ask whether you would like to be on screen or not. These recordings will be kept and made available to others in the Membership. Should you not wish to be recorded please ensure that if you attend any training your camera is switched off and your name field is changed to “Attendee” with your initials so that support can still be offered but no personal identifiable information will be captured. 

Your log-in details must remain confidential, and you must not disclose this information to a third party, without our express permission in writing. If you know, or suspect, that your log-in details have been obtained by a third party, you agree to change your password immediately, and provide notification of the same as soon as possible to [email protected]. 

9. Intellectual Property 

During your time as a Member you may be provided with resources for making the most of your reading life. At all times, the intellectual property rights and copyrights connected with those materials remain with us. You have the right to use the materials as learning tools but you are not permitted to duplicate, republish, reproduce, distribute, translate or provide copies to third parties. We retain and reserve all of our copyrights.

10. Force Majeure 

Where either party is prevented from or delayed in carrying out its obligations under these Terms, due to circumstances beyond their reasonable control including, but not limited to, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, inclement weather, pandemic/epidemic, lock-outs, strikes or other employment disputes, performance of their obligations shall be postponed until these circumstances end.

11. Waiver 

In the event that we fail to insist upon your strict performance of any obligations under these Terms, or we fail to exercise any rights or remedies to which we are entitled, this will not constitute a waiver of any such rights and / or remedies available to us. 

12. Errors and Inaccuracies

There may be information within our Site or the Membership which contains typographical errors, inaccuracies or omissions relating to the service delivery, pricing or promotion of the Membership. We reserve the right to correct or amend any errors without prior notice.

13. Jurisdiction 

These Terms are governed by the laws of the State of Tennessee. The Tennessee Courts have exclusive jurisdiction over any matter and proceedings arising out of the Membership.

14. Complaints 

It is our aim that you are completely satisfied with the Membership. Should you have any feedback please feel free to share it with us as we are always striving to ensure that we provide you with the highest level of service. If you have a complaint about the Membership this should be made in writing to [email protected].

15. General

We intend to rely on the written Terms set out in Terms and Conditions for the services that we provide to you in delivery of the Membership. These written Terms shall constitute the entire agreement between us.

Should there be any conflict between these Terms and any Membership hosting platform or payment gateway, these Terms shall prevail. 

If any provision within these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant provision will be deemed to be deleted).

No provision within these Terms shall be enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of your service. Any changes will be notified to you as soon as possible.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. Analytics

Our hosting provider monitors traffic and maintains logs including IP addresses for performance and security reasons.

Who we share your data with

We use several services to manage our checkout process for registering new subscribers and processing purchases in the shop.

WooCommerce is our shopping cart provider. We provide them with details about your order including name, email, phone, and physical address.

Stripe is our payment gateway. We provide them with details about your transactions including name, email address, and credit card information.

Klayvio is our email marketing provider for sending updates on upcoming products, sales, company news, and subscription renewal notices. QuickFill is our Magazine Subscription Fulfillment software. We provide them with details about your order including name, email, phone, and physical address.

Virtuous is our Donor Database. We provide them with details about your donation including name, email, phone, and physical address.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

The For Girls Like You Ministries mobile message service (the “Service”) is operated by For Girls Like You Ministries (“For Girls Like You Ministries”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to For Girls Like You Ministries’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of For Girls Like You Ministries through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with For Girls Like You Ministries. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18449461517 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other For Girls Like You Ministries mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
